Musician friends celebrate Thielemans' 90 years

NEW YORK (AP) ? Jazz harmonica virtuoso Toots Thielemans quipped that his legs don't work but his mouth does after he was pushed onstage in a wheelchair to a standing ovation during the first of two Jazz at Lincoln Center concerts this weekend celebrating his 90 years. And once he put his harmonica to his lips, he more than lived up to his words.

Thielemans, who has been in poor health, had only played once this year at a summer jazz festival in his native Belgium and had canceled all his other U.S. dates. JALC programming director Jason Olaine said that up to the last minute, the producers were not sure whether Thielemans would even be able to play at the tribute concerts.

But energized by an enthusiastic audience and his musical friends, Thielemans rose to the occasion. Among those paying tribute were American jazz pianists Herbie Hancock and Kenny Werner, and three Brazilian stars, guitarist-vocalist Dori Caymmi, pianist-vocalist Eliane Elias and guitarist Oscar Castro-Neves ? all of whom appeared on Thielemans' two "Brasil Project" CDs in the early 1990s.

Thielemans, who turned 90 in April, was the first musician to create full-fledged jazz improvisations on the harmonica. But he's also made his mark in pop culture ? as the whistler on the Old Spice commercials; playing harmonica on the themes for "Sesame Street" and the film "Midnight Cowboy;" and in performances with Paul Simon and Billy Joel. He was ennobled by Belgium's king as a baron in 2001 and received the National Endowment for the Arts Jazz Masters award in 2009, the highest U.S. jazz honor.

Werner opened Friday night's concert at the Rose Theater by playing two ballads ? Michel Legrand's "You Must Believe in Spring" and Bill Evans' "Very Early," which were on his 2001 duets album with Thielemans. Then Caymmi and Castro-Neves joined the band to play two Brazilian standards, including "Aquarela do Brasil," the title track of a 1969 recording Thielemans made with bossa nova singer Elis Regina that made him a hero to Brazilian musicians.

"When I heard Toots Thielemans for the first time, I'd like to tell you I was a baby," Caymmi said. "I was impressed like I was by Gil Evans, John Coltrane and Wes Montgomery."

Thielemans made his first appearance of the evening to play Caymmi's composition "Obsession" with the band; a Gershwin medley of "I Love You Porgy/Summertime" and Antonio Carlos Jobim's "Chega de Saudade," considered the first bossa nova song, with Werner; and Jacques Brel's "Ne me quitte pas" with Elias.

Hancock opened the second half by recalling that he first heard Thielemans when he was 14 years old with the George Shearing Quintet, a group he said greatly influenced him when he first became interested in jazz. He later played with Thielemans on records with Quincy Jones and others.

Hancock dedicated a spontaneously improvised piece ? with lots of classical influences ? to his Belgian friend, and then Thielemans joined him for a playful free-form duet loosely derived from Miles Davis' "Blue and Green." Thielemans stayed on stage to play a Sinatra medley ("All the Way/My Way") duet with Werner and joined with Elias to play her ballad "Moments," 'which he played on her first CD for Blue Note Records.

After Elias and Castro-Neves played several Brazilian tunes to give Thielemans a break, he returned one more time. He dedicated his composition "For My Lady" to his wife, Huguette.

"In this world I wouldn't certainly be here if it were not for my lady. She pays all the dues I should be paying," Thielemans said, addressing his wife in the audience before playing the tune with Werner and Castro-Neves.

All the musicians returned to the stage to play Thielemans' best known composition, "Bluesette," possibly the first swinging jazz waltz that was composed 50 years ago. Hancock and Elias engaged in some playful four-handed piano playing as the audience sang and clapped along with the musicians.

For an encore, Thielemans thanked everyone by caressingly playing "What a Wonderful World" ? a dedication to Louis Armstrong. He exited the stage standing proudly, supported by his fellow musicians, as the audience serenaded him with "Happy Birthday."

Orioles beat Boston, gain tie for AL East lead

BALTIMORE (AP) ? The Baltimore Orioles are tied atop the AL East with the New York Yankees with four games left, a scenario that might cause a team unaccustomed to being in a pennant race to stumble under pressure.

Not these guys.

After Baltimore beat the Boston Red Sox 4-3 Saturday night to earn a share of first place, Orioles first baseman Mark Reynolds described the mood of the team as "a quiet confidence."

"Calmness," Reynolds said. "We're playing with house money. We're not supposed to be here. We're just a bunch of kids having fun. We go out every night believing we're going to win the game, no matter what the situation and no matter who we're facing. It's just fun to be a part of."

Chris Davis hit his 30th home run and rookie Manny Machado lined a go-ahead shot in the seventh inning for the Orioles. After finishing in the division cellar in each of the previous four seasons, Baltimore (91-67) is tied with a team very much accustomed to finishing in first place.

The Yankees lost to Toronto before this game started, so the Orioles knew they would earn a share of the lead with a win. Baltimore went ahead 3-0 in the fourth, then let Boston pull even before Machado homered, a liner into the second row of the left-field seats off Felix Doubront (11-10).

Machado has been a major leaguer for all of 47 games after being summoned from Double-A Bowie on Aug. 9.

"I'm just trying to play the game," he said. "Obviously, it's bigger than any other games I've played before. I'm just going to try and go out there and give everything I can to help this team win."

It was another tight victory for the Orioles, their trademark in this unimaginable season. Baltimore is 28-9 in one-run games and 72-0 when leading after seven innings.

"It's an honor to sit there and watch it and marvel at what these guys can do, especially when certain things start snowballing," manager Buck Showalter said. "And you create your karma. These guys have done a good job of doing that, and they're expecting good things to happen."

Tommy Hunter (7-8) pitched two innings, Brian Matusz and Darren O'Day shared the eighth and Jim Johnson got three outs for his 49th save.

A sellout crowd of 46,311, a majority of them clad in Oriole orange, brought Camden Yards back to a time when the home team was a force in the AL East and the ballpark was packed on a nightly basis.

The fans got to cheer a Baltimore great before the first pitch, too. A statue of Hall of Fame third baseman Brooks Robinson was unveiled during a ceremony in the flag court beyond the center-field wall.

The Orioles' goal is to capture the division, but if they win two more games they are at least assured of their first trip to the playoffs since 1997 ? their last winning season before this year. Baltimore now is 41-27 in the division and New York is 37-31, so if Baltimore wins one more game, it will have home-field advantage if there's a playoff to decide the AL East title.

"The pressure's on both of us," Reynolds said. "Four games left, dead heat. I guess there's a possibility of two playoff games. It's what we play for, and it's fun."

In addition to hitting two homers and limiting Boston to five hits, Baltimore also played well defensively. Machado, the third baseman, ranged far to his right in the fourth inning to start a double play, and Reynolds tumbled over the tarp roll and got wedged behind it after catching a foul pop. Endy Chavez, who entered as a defensive replacement in the ninth, made a sparking diving catch of a sinking liner to right field.

"They just keeping doing what they have to do," Red Sox manager Bobby Valentine said of the Orioles. "Buck knows what he's doing. He puts in a defensive replacement and he makes a diving catch. They've done a great job with that young third baseman. He beat us tonight. He played excellent defense all year."

Jarrod Saltalamacchia homered for the Red Sox, who fell into last place with their 15th loss in 21 games. Boston has not finished in the cellar since 1992.

Doubront allowed four runs, three earned, and seven hits in seven innings. He struck out 10, walked one and hit a batter.

Red Sox leadoff hitter Jacoby Ellsbury went 1 for 4 after being sidelined since Sept. 20 with an unspecified injury. Ellsbury has only four homers and 26 RBIs after finishing second in AL MVP voting last season.

"I didn't see him play that way this year," Valentine said before the game. "He did not quite hit his stride this year."

Orioles rookie Steve Johnson took a three-hitter and a 3-2 lead into the sixth inning but was lifted after giving up a single and a walk. Hunter got Dustin Pedroia to hit a force at second, but a run came home when Cody Ross hit a sacrifice fly to right field that Davis dropped after Adam Jones drifted over from center and called for the ball. Hunter avoided further damage by getting Mauro Gomez to bounce into a double play.

Baltimore went up 1-0 in the second when Machado singled in a run after Doubront hit Davis with a pitch and Reynolds reached on a slow roller to third.

In the fourth, after Jones reached on a throwing error by shortstop Mike Aviles, Davis drove a 1-0 pitch far over the right-field wall for a 3-0 lead.

Saltalamacchia hit his 25th homer in the fifth after Gomez drew a leadoff walk.

UN Already Looking at Global Taxes

Editor?s Note: This is what they wanted all along. If they can?t get their carbon or Internet tax, they?ll get their austerity tax or whatever trumped up name they come up with.

A?1 percent tax on billionaires around the world. ?A tax on all currency trading in the U.S. dollar, the euro, the Japanese yen and the British pound sterling.? ?Another? ?tiny?? tax on all financial transactions, including stock and bond trading, and trading in financial derivatives. ?New taxes on carbon emissions and on airline tickets. ?A royalty on all undersea mineral resources extracted more than 100 miles offshore of any nation?s territory.

The United Nations is at it again:? finding new and ?innovative? ways to create global taxes that would transfer hundreds of billions, and even trillions, of dollars from the rich nations of the world ? especially the U.S. ? to poorer ones, in line with U.N.-directed economic, social and environmental development.

These latest global tax proposals have received various forms of endorsement at U.N. meetings over the spring and summer, and will be entered into the record during the 67th? U.N. General Assembly session, which began this week. The agenda for the entire session, lasting through December, is scheduled to be finalized on Friday.

How to convince developed countries wracked by economic recession and spiraling levels of government debt ? especially the U.S. ? is another issue, which the world organization may well end up trying to finesse.

As the U.N. itself notes, in a major report on the taxation topic titled, ?In Search of New Development Finance? ? the main topic at a high-level international meeting of the U.N.?s Economic and Social Council (ECOSOC) this summer ? ?These proposals are subject to political controversy. For instance, many countries are not willing to support international forms of taxation, as these are said to undermine national sovereignty.?

The U.N. clearly hopes it can find a way to move ahead. ? Politically, tapping revenue from global resources and raising taxes internationally to address global problems are much more difficult than taxing for purely domestic purposes,? admits an ECOSOC document produced last April. But, it summarizes, ??the time has come to confront the challenge.?

Shortly thereafter, the tax proposals ? known in U.N.-speak as ?innovative methods of financing?? got a limited endorsement from a group of government ministers and other heads of national delegations who attended a major ECOSOC meeting in New York City in July.

The global taxation idea was echoed this week by Jeffrey Sachs, head of Columbia University?s Earth Institute and also a U.N. Assistant Secretary General. Sachs was recently named by U.N. Secretary General Ban Ki-moon to head a new intellectual lobbying group of experts called the Sustainable Development Solutions Network.? It ?will work closely with United Nations agencies, multilateral financing institutions and other international organizations,? according to the Earth Institute website.

On Monday, the controversial economist, a vociferous supporter of the Occupy Wall Street movement, called on President Obama to implement a carbon tax that in turn could be used to finance bonds, paying for investments to combat ?climate change? ? one of the major focuses of the new solutions network.

Sachs was quoted by Bloomberg News as declaring that, ?I?m happy to have the future pay for a lot of this. It doesn?t have to be current financed.?

In the midst of a heated U.S. national election campaign, any official endorsement of those views is unlikely.

Nonetheless, the U.N. is taking a longer view. The world organization, and its constellation of funds, agencies and programs, has been pushing ?innovative financing? for nearly a decade, since the topic was discussed in depth at an international conference in 2002.? The topic was endorsed again at the failed Rio + 20 conference last summer, without much detail attached.

But the need for new revenue is becoming more urgent as the world?s rich countries, gripped in recession, no longer hand out foreign aid with the same generosity as before ? though the total reached $133 billion annually last year?while the demands for huge additional amounts of money for social and climate issues continues to grow.

Earlier this year, for example, the overseers of a new, U.N.-sponsored? Green Climate Fund held their first meeting in Bonn to contemplate the spending of some $30 billion annually ? rising to $100 billion by 2020 ? to meet climate change needs in developing countries.? Where all that money will come from is still not clear.

The U.N.?s latest roster of tax possibilities certainly has what the New Development Finance Report calls ?large fundraising potential.? Or, at least some of them do. An around-the-world tax of $25 per ton on carbon dioxide emissions in rich countries, the report says, could raise some $250 billion a year. That new billionaire?s tax would raise anywhere from $40 billion to $50 billion per year, the report estimates, though it adds that the idea ?is not yet in any international agenda.?

The U.N. places the same estimated value on the proposed currency tax ($40 billion), and roughly the same thing on its proposed financial tax ($15 billion to $75 billion).

Even more innovative is a notion to, in effect, borrow the lines of credit allocated to rich countries themselves at the International Monetary Fund, and? ?leverage? them to create new investment funds for the world?s poor. How to do this while preserving those credit lines as a reserve asset that rich countries could draw on when required, the report admits, remains to be seen.

Another ?innovative? idea that may have trouble staying afloat is the notion of charging royalties on undersea minerals more than 100 miles offshore, within what are called ?exclusive economic zones? ? in effect, inside some country?s sovereign economic territory.

The sensitive issue here is that the world?s current ?exclusive economic zones? extend 200 miles offshore ? meaning that the U.N. is suggesting that it collect royalties on mineral wealth on half the ?exclusive? territory, which it refers to in the report as part of the ?global commons.?

For most nations, excluding the U.S., those 200 mile zones were established by the U.N.-sponsored Law of the Sea Treaty, known as LOST, which came into force in 1994 after it was signed and ratified by 162 countries. (The U.S. signed but has not ratified LOST; its 200-mile ?exclusive economic zone? was established by presidential decree.)

The new, 100-mile royalty proposal in the U.N.?s financing report would require a new agreement to hand over proceeds from half of that territory to the U.N.-sponsored International Seabed Authority.

Colleges try new fixes to recurring remedial rut

WEST PLAINS, Mo. (AP) ? After leaving high school as a teen mother, Ashley McCullough is back on track to receive a two-year degree and work as a respiratory therapist. But she first had to conquer a remedial math class and its core lessons on addition, subtraction, multiplication and division ? the same basic skills her now 6-year-old daughter will soon start to learn in elementary school.

"I didn't have my act together," the 23-year-old said. "I had a baby at 16."

McCullough is far from alone at Missouri State University-West Plains, a two-year school nestled in the southern Missouri Ozarks near the Arkansas border where roughly three out of every four students take at least one remedial class.

That's well above the national estimates of remedial participation rates of 20 percent to 30 percent at four-year schools and more than 50 percent at community colleges. And like their counterparts at public flagship universities, rural teacher colleges and urban commuter campuses, many of McCullough's classmates will drop out before advancing to the next course, let alone graduate or move on to a four-year school.

It's forcing those on the front lines to try dramatically different approaches, from tweaking the standards that determine who needs extra help to allowing remedial students to simultaneously take the introductory classes they were once barred from.

The changes come as impatient lawmakers in states such as Connecticut, Kansas, Ohio and Tennessee are restricting or eliminating remedial classes at public colleges, or even threatening to withhold money from schools that don't do a better job of preparing unprepared students for the rigors of college. In Washington, President Barack Obama has challenged two-year and four-year schools to improve workforce training and college completion rates.

"When you have 35 percent of students passing your course, that is not acceptable," said Missouri State math specialist Thora Broyles. "Something had to be done."

At West Plains, the first step was hiring an administrator to focus solely on what practitioners prefer to call developmental education, rather than assign the task to a disinterested or overburdened faculty member.

The nomenclature is more than symbolic, said Mirra Anson, who was hired as the school's "dev ed" director thanks to a five-year federal grant.

"With remedial education, the connotation is we are making up for things they didn't learn in high school," she said. "But with dev ed, we are developing the skills they need to have to be successful. There's a different connotation there. There's no need to remediate what they didn't have in high school, because that part of their life is over. So let's move forward now and talk about what you need."

That means no more lectures for Broyles' remedial math students, who instead work on self-paced lessons in computer labs. Rather than lecture, Broyles instead works individually with students, aided by two tutors culled from the ranks of advanced students. The approach, developed at Virginia Tech Univeristy, is known as the "Emporium" model. Some students complete the two remedial classes and a required college algebra class in one semester; others take weeks before even moving past simple equations.

"I like the fact they give you the option to work at your own pace," said McCullough, who completed high school in a home-based program after her daughter's birth and now has another child who soon turns 2. "I probably wasn't on the same level that everybody else was (who had enrolled) right out of high school."

New West Plains students struggling with basic grammar, punctuation and argumentative writing now take the same freshman composition course as their more advanced peers, but separate into smaller groups ? with the same professor ? for a pass-fail developmental English class that builds on the work covered in the more advanced writing class. The "accelerated learning program" is modeled on a similar effort at the Community College of Baltimore County in Maryland.

Sydney Wilson, an aspiring teacher from Houston, Mo., expects to receive her associate degree in the spring and a four-year diploma from the school in 2014 after successfully completing the accelerated English course.

The teacher "could take everything we were writing about in the first English class, and in the second class, we'd just write about it in more detail," Wilson said. "So I wasn't writing two separate papers for each class, it was just tied together as one."

Like most schools, West Plains uses student scores on the ACT or other standardized college entrance exams to determine who needs additional help. That approach has come under fire from some reformers who question whether other measures, such as high school grade-point average or course evaluation, are predictors that are more accurate. Two recent studies by the Community College Research Center at Columbia University's Teachers College found that up to one-third of new students in the examined school systems were improperly placed in remedial classes.

And a scathing report released in May by the Washington-based nonprofit Complete College America called remediation "higher education's bridge to nowhere," traveled by nearly 1.7 million U.S. college students, with almost four in 10 community college remedial students not completing those courses and just one in 10 graduating from those schools.

The challenges of remedial education, though, transcend curriculum, said Rebecca Goosen, dean of college preparatory at San Jacinto College in Texas and president of the National Association of Developmental Education.

For many, life challenges become all consuming, she said, from the single mother losing a reliable babysitter to the teenager who can't afford to fix a broken-down car.

"People are trying to find the silver bullet," Goosen said. "It's a very complex issue...We are not going to fix, in a 16-week period, what's been broken for years."

In West Plains, college students also struggle to excel in a region marked by high poverty and unemployment, low cultural expectations and public schools where the quality of education varies widely, numerous students, teachers and school Chancellor Drew Bennett said in interviews.

For Bennett, that means offering students what he calls the "Missouri State-West Plains Promise," a one-time guarantee that allows students who receive a "D'' or "F'' grade that causes their grade-point average to sink below 2.0 to retake the same class the next semester at no cost ? provided the students have no more than two class absences, submit assignments on time, and seek outside help from teachers, advisors and tutors.

Bennett, an ex-Marine and National War College professor, reinforces that message and other important university missives by reaching students where they congregrate, which includes reminders and motivational tips posted in a weekly restroom newsletter known as the "Stall Study."

Yet for all of the schools' efforts ? its innovations have attracted acclaim from the Aspen Institute as one of the country's top 30 community colleges ? the hurdles its student face outside the classroom can appear insurmountable.

Single mother Kristi Hargrove, 39, returned to campus in 2009 after dropping out following just one semester nine years earlier: "I was too young to know any better and too young to care," she said.

Placed into remedial math, she struggled to keep up. But a series of personal upheavals ? from her brother's death to a broken engagement ? culminated with Hargrove again dropping out earlier this year, 20 credits shy of her associate degree in nursing.

"The pressure just kicked in, and I had to quit school," she said. "I call the Ozarks 'quicksand.' Once you're here, you're here (for good), and can't make enough money to get out."

Elizabeth Kusel, 42, returned to school at West Plains after first enrolling at a two-year school near her southern Oregon home more than a decade ago. A single mother, she lived in a women's domestic violence shelter with her two sons, ages 8 and 9, after her divorce and is now an honors student with hopes of attending the University of Virginia and law school at Stanford.

She too had to survive Math 20, the remedial class that defeated too many of her fellow freshmen. Kusel sympathizes with those who don't make it.

"There have been a lot of days I ask, 'Why am I doing this?'" she said. "It would be so much easier to go get a dead-end job and pay everything off and not go through this."

Pirelli will be the official tire supplier of the series with the Cinturato ?Green Performance? family.

The three-day, 600 kilometer competition is restricted to vehicles utilizing alternative energy. Unlike other rallies, the Green Rally of Montr?al runs its course on the open road and follows the legal speed limits.

Drivers are challenged in operating their vehicles in the most efficient manner possible since consumption index ? the relationship between the energy used and the weight of the vehicle ? is taken into account in the final scoring.

?We?re truly excited to participate in this year?s Green Rally of Montreal,? said Mattia Bussacchini, president of Pirelli Canada. ?The Cinturato tire has over 60 years of motorsport history and this will be a fantastic way to demonstrate the latest technology and advancements in an increasingly eco-conscious environment.?

Pirelli says its ?Green Performance? range is noted for its low rolling resistance, reduced road noise and high mileage. New eco-friendly materials result in the elimination of highly aromatic oils from the compounds and minimize environmental impact, both at the production stage and over the life of the tire.

The Green Rally of Montr?al complies with the International Sporting Code and is a sanctioned race as part of the International Championship of the Alternative Energy Cup organized by the F?d?ration Internationale de l'Automobile (FIA).

The NFL?s adroitly-drafted statement regarding the Monday night debacle in Seattle glosses over the most important question presented by the play.

What if Packers safety M.D. Jenning gained control of the ball before Golden Tate?? As we address that question, keep in mind the difference between ?control? and ?possession.?

?When the players hit the ground in the end zone, the officials determined that both [Seahawks receiver Golden] Tate and Jennings had possession of the ball,? the league?s statement explains.? ?Under the rule for simultaneous catch, the ball belongs to Tate, the offensive player.? The result of the play was a touchdown.?

In reality, the outcome was determined before the players hit the ground.? That?s when Jennings first gained ?control? of the ball, regardless of whether Tate eventually secured simultaneous ?possession? of it.

The relevant portion of the official 2012 rules comes from Rule 8, Section 1, Article 3, Item 5:? ?It is not a simultaneous catch if a player gains control first and an opponent subsequently gains joint control.?? (Emphasis added.)? Thus, it doesn?t matter whether the officials determined that Tate and Jennings jointly had ?possession? when they landed; the question is whether Jennings ?gained control? first.

The NFL?s statement likely omitted that fact because the video shows Jennings ?gained control? first.? This video shows the best angle; Jennings caught the ball with both hands while Tate had only one hand (his left) on the ball.? Tate eventually got his right hand on the ball, but after Jennings ?gained control? of it.

The league?s most recent casebook, which is posted at NFL.com, specifically addresses this situation at A.R. 8.29, under the all-caps title NOT A SIMULTANEOUS CATCH:? ?First-and-10 on A20. B3 controls a pass in the air at the A40 before A2, who then also controls the ball before they land. As they land, A2 and B3 fall down to the ground.? Ruling: B?s ball, first-and-10 on A40. Not a simultaneous catch as B3 gains control first and retains control.?? (Emphasis added.)

Some Seahawks fans defend the indefensible claim that the catch isn?t complete until the players land on the ground, citing the ever-confusing ?Calvin Johnson rule,? which makes a catch not a catch until the player maintains possession through the act of going to the ground.? They cling to that principle for a very good reason; the league?s statement specifically quotes the rule, blurring the line between ?control? and ?possession.?

Consider the plain language of the rule regarding a completed pass:? ?A forward pass is complete (by the offense) or intercepted (by the defense) if a player, who is inbounds: (a) secures control of the ball in his hands or arms prior to the ball touching the ground; and (b) touches the ground inbounds with both feet or with any part of his body other than his hands; and (c) maintains control of the ball long enough, after (a) and (b) have been fulfilled, to enable him to perform any act common to the game (i.e., maintaining control long enough to pitch it, pass it, advance with it, or avoid or ward off an opponent, etc.).?

This isn?t about maintaining control through the act of going to the ground; it?s about who first secured control, whether the players were in the air or on the ground.? Jennings first secured control, while he and Tate were in the air.

Here?s A.R. 8.29, with the names of the player?s included:? ?Jennings controls a pass in the air before Tate, who then also controls the ball before they land. As they land, Tate and Jennings fall down to the ground.? Ruling:? Green Bay?s ball.? Not a simultaneous catch as Jennings gains control first and retains control.?

Though it gets complicated, it?s actually pretty simple.? Jennings gained control first.? Tate, at best, secured joint control later.? That?s not a simultaneous catch.

Then there?s the faction of Seahawks fans who believe that there was insufficient visual evidence to overturn the ruling on the field, regardless of whether the ruling was touchdown or interception.? But that?s where the league?s statement also is wrong.? It?s indisputable that Jennings gained control first, as evidenced by Jennings having two arms at the ball when Tate has only one.

As a result, we reject the league?s statement as the predictable sort of wagon-circling in which the league has been engaged ever since it put third-rate-at-best officials into the costume and pawned them off as sufficiently competent to rise to the challenge of officiating an NFL game.? The very complexity of this rule proves that these officials lack the ability to remember, interpret, and apply these principles in real time.

Of course, the non-replacement replay official and the non-replacement league supervisor screwed this one up, too.? Which perhaps highlights the importance of having non-replacement officials who know these rules and can apply these rules on the field at all times.

Manufactured goods orders tumble by 13.2%

New orders for long-lasting U.S. manufactured goods in August fell by the most in 3-1/2 years, pointing to a sharp slowdown in factory activity even as a gauge of planned business spending rebounded.

The Commerce Department said on Thursday durable goods orders dived 13.2 percent, the largest drop since January 2009, when the economy was in the throes of a recession. Orders for July were revised down to show a 3.3 percent increase instead of the previously reported 4.1 percent gain.

Economists polled by Reuters had expected orders for durable goods -- items from toasters to aircraft that are meant to last at least three years -- to fall 5 percent.

Last month, the drop in orders reflected weak aircraft and automobiles demand. Boeing received only one aircraft order in August, down from 260 in July, according to information posted on the plane maker's website.

Transportation equipment tumbled 34.9 percent after racing ahead 13.1 percent in July. Excluding transportation, orders fell 1.6 percent after dropping 1.3 percent the prior month. Economists had expected this category to rise 0.3 percent after a previously reported 0.6 percent fall.

Non-defense capital goods orders excluding aircraft, a closely watched proxy for business spending plans, rose 1.1 percent, halting two straight months of hefty declines. That was above economists' expectations for 0.5 percent gain.

But shipments of these goods, which are used to calculate equipment and software spending in the gross domestic product report, fell 0.9 percent after declining 1.1 percent in July. The weakness suggested third-quarter economic growth would probably not improve much from the April-June's 1.3 percent annual pace.

Manufacturing, which has been the main driver of the recovery from the 2007-09 recession, has been hit by turbulence from sluggish domestic and global demand.

Fears that the U.S. Congress could fail to avert a "fiscal cliff" -- the $500 billion or so in expiring tax cuts and government spending reductions set to take hold in 2013 -- have also left businesses with little incentive to boost production.

Family Found Dead in Herndon Home - Herndon, VA Patch

Fairfax County Police are investigating the death of four family members inside a Herndon home Tuesday morning.

Officer Bud Walker, a spokesperson for the department, said police were called at 10:37 a.m. Tuesday for a welfare check at the home, located in the 13300 block of Point Rider Lane in Herndon, VA.

Upon arrival, officers found four family members dead inside the home.

Homicide and crime reconstruction detectives have blocked off the area to investigate Tuesday afternoon, Walker said.

Next of kin has not been notified, Walker said, "but there appears to be no threat to public safety."

Deer Obama: Surprise campaign-sign vandal caught on video

An Austin, Texas, couple were convinced a political vandal was at work, showing up in the middle of the night to damage their yard sign endorsing President Obama's re-election campaign. But after contacting police, Beth and Tom Priem were shocked to discover the guilty party was actually a "Republican" deer.

Austin NBC affiliate KXAN reports that the mystery began in mid-September, when the Priems found holes punched through their Obama sign four days in a row. It seemed like a personal attack, as none of their yard signs for other political candidates had sustained any damage.

And further adding to the mystery, the Priems have several politically active neighbors, all of whom support Republican candidates and none of whom suffered any damage to their yard signs.

The Austin couple then called police, who were at a loss as to who might be the culprit. But it was actually the family's dog that first spotted the culprit, barking at the family's living room window and drawing Beth and Tom to the scene.

"Apparently, we have a Republican deer in our neighborhood!" Tom told KXAN. "The funny thing is, I haven't seen any other signs damaged. The people directly across the street have four signs; the person across the street and to the left has two, and the next house to the left h as one. We can't figure out why the deer is attacking our signs."

And since this situation is not likely to be resolved through more conventional political debate, the Priems have decided to take direct action instead.

"We're going to put them up closer to the house, and hopefully if it's not right in their path they'll leave it alone," Tom said.

Republic Wireless is pretty candid that it's still learning the ropes of the mobile world, but with its monthly service cost of $19 per month, we know more than a few people who'd like to help test the water. Most recently, the company admitted an error with its deployment of a single-band Motorola Defy XT, which is compatible only with Sprint's 1,900MHz network. While this is fine for many -- especially given that subscribers are primarily expected to use WiFi -- it's presented a more tangible challenge for those who live within or travel to areas that rely on 800MHz service. Don't be alarmed, however, because the company is going to make it right.

From today, Republic Wireless subscribers in waves B through E will have 30 days to evaluate their service, and if it's unacceptable, may seek a full refund from the provider. Those who are willing to wait it out, however, will receive a free dual-band Defy XT when it becomes available. Similarly, the company is incentivizing the upgrade for those in wave A with a $100 discount. Meanwhile, it will continue to offer the single-band Defy XT to those in waves F and beyond, but alternatively, it'll also keep the door open for its invitees to come aboard once the dual-band version is available -- it certainly seems wise to hold out for the dual-band version if you're able.
