Health and Fitness: Fun four-minute workout more effective than cardio

Sounds almost too good to be true, but according to fitness researchers it?s not. A recent study published in the Journal of Applied Physiology, Nutrition, and Metabolism tested traditional treadmill cardio against a fast-paced bodyweight workout.

Twenty two college-aged, active women split into three groups and did four workouts per week for a month?s duration.

Group A did 30 minutes of treadmill running at 85 percent maximum heart rate.

Group B did eight rounds of 20 seconds of a single exercise (burpees, jumping jacks, mountain climbers, or squat thrusts) with 10 seconds of rest between rounds.

Group C did nothing, they were the non-training control group.

The participants enjoyment and the likelihood of them continuing the workout plan were also examined prior to and after training.

Following training, both Groups A and B increased their aerobic fitness levels by the same amount, 7-8 percent. The much shorter bodyweight workout got the same aerobic results as the more traditional 30 minutes of cardio on the treadmill. However only Group B, the bodyweight workout group, saw an increase in muscle endurance in common exercises like leg extensions (plus 40 percent), chest presses (plus 207 percent), sit-ups (plus 64 percent), push-ups (plus 135 percent), and back extensions (plus 75 percent). Group B got much more bang for their buck, not only improving cardiovascular endurance, but also drastically improving muscle endurance as well.

The researchers concluded that, ?although improvements in cardiovascular fitness are induced by both, whole-body resistance training imparted an additional benefit in the form of improved muscle endurance.? Fast-paced bodyweight training can improve cardiovascular fitness just as well as running on a treadmill, and give better improvements in muscle endurance. All this in just 4 minutes. The best part was that the participants enjoyed the bodyweight workout more and intended to continue the training program more than the treadmill running.

Total body movements should be the foundation for any fitness programs, whether it is for fat loss, athletic improvement or gaining size and strength. Traditional cardiovascular exercise is great if you like to run although if you want to improve your aerobic fitness and look better at the same time, try adding some bodyweight exercises. You might actually like it.

NFL Week 17 Checkdown: Adrian Peterson's superhuman feat sweeter with playoff berth

Minnesota Vikings running back Adrian Peterson came up 9 yards short of the best single-season rushing total in NFL history on Sunday. But his 199-yard effort on a career-high 34 carries in Minnesota's wild 37-34 home victory over the Green Bay Packers came with a much sweeter record?his team's 10-6 mark that ensured the NFC's wild-card No. 6 seed.

Peterson's 26-yard run with 24 seconds left put the Vikings in position for Blair Walsh's game-winning 29-yard field goal. Although there were still 11 more yards between the Vikings and the goal?more than enough to pass Eric Dickerson's total of 2,105?Peterson's remarkable season still had a storybook ending.

Consider where Peterson was a year ago. On Christmas Eve 2011, against the Washington Redskins, he tore the ACL and MCL in his left knee, a grisly injury that would put the career of mere mortal backs in jeopardy. Two days later, he was put on injured reserve, the unofficial start of a long rehabilitation process that included recovery from reconstructive surgery he underwent last Dec. 30.

It's appropriate that Peterson became the seventh running back in NFL history to join the 2,000-yard rushing club (2,097 to be exact) exactly one year later. It's a testament to the relentless work ethic that got him back on the field and kept him at full strength all season long. It's just another reason why he's a special modern athlete who evokes the memories of legends past, including Jim Brown and Walter Payton.

Peterson accomplished what Brown and the late Payton never did during their illustrious time on the gridiron. Although Peterson didn't quite catch Dickerson, he trumped the best years of Barry Sanders and O.J. Simpson.

In an era where many teams have gone to backfields-by-committee and 20 touches are now considered big workloads, Peterson's hard-charging, reckless-abandon style is a refreshing respite. Even though the Packers?against whom he had rushed for 210 yards three weeks ago?knew he was going to get the ball often, they still had limited answers.

The Packers were so geared toward stopping him, it set up some of the easiest throws for Christian Ponder on a day the second-year quarterback needed to make them. One came on a 2-yard touchdown strike in the third quarter to Peterson, who also scored on a 7-yard run in the first quarter that set the tone early in a must-win game.

The reward for Peterson leading a great team effort is a third matchup with the Packers, this time in Lambeau Field. Just like Sunday and back in Week 13 in Green Bay, the Vikings won't be shy about riding Peterson again. The Packers will go back to the drawing board looking for ways to stop what's coming.

Ever since Peterson made a splash as a dynamic rookie in a Vikings timeshare with Chester Taylor in 2007, it's been fun to watch Peterson run with no regard for his safety, or that of those trying to stop him. Whether it's been defenders or damaged ligaments, it's a joy to know that there's no obstacle he hasn't been able to hurdle.

Peterson has made a very strong case for MVP, and at worst should take home the awards for both Offensive Player of the Year and Comeback Player of the Year.

But even Peterson's near-record season may not be enough to stop the MVP momentum of Broncos quarterback Peyton Manning. Thanks to the Houston Texans' loss at Indianapolis earlier in the day, Manning and Denver clinched the top seed and home-field advantage in the AFC playoffs with a 38-3 rout of the Kansas City Chiefs. That also opened the door for Tom Brady and New England to take the No. 2 seed and the second bye after beating the Miami Dolphins, 28-0.

What that means is the Broncos (13-3) and Patriots (12-4) are on a collision course for the AFC championship, rather than a divisional-round meeting. The Broncos' victory over the Chiefs was their 11th in a row overall. Their last loss came at New England, 31-21, on Oct. 7 in Week 5. Since then, the Broncos have improved every week, with Manning getting into a groove with all his receivers and the defense developing into a dominant unit. The Patriots have made more offensive mistakes than usual of late, and know now the rematch would be in Denver and not Foxborough.

John Elway and the Broncos brought in Manning with one goal in mind: the Super Bowl. It only makes sense that they'll likely need to go through Brady to attain it. In Denver, Manning has a more complete team around him than many of his Colts teams in Indianapolis. The Broncos are the deserved heavy favorite to win the AFC.

Worlds collide in Indian girl's rape and death

NEW DELHI (Reuters) - One of hundreds of attacks reported in New Delhi each year, the gang rape and murder of a medical student caught Indian authorities and political parties flat-footed, slow to see that the assault on a private bus had come to symbolize an epidemic of crime against women.

In the moments before the December 16 attack, the 23-year-old woman from India's urban middle class, who had recently qualified as a trainee physiotherapist in a private Delhi hospital, and her male friend, a software engineer, were walking home from a cinema at a shopping mall in south Delhi, according to a police reconstruction of events.

A bus, part of a fleet of privately owned vehicles used as public transport across the city of 16 million, and known as India's "rape capital", was at the same time heading toward them. Earlier that day, it had ferried school students but was now empty except for five men and a teenage boy, including its crew, police said. Most of the men were from the city's slums.

One of the six - all now charged with murder - lured the couple onto the bus, promising to drop the woman home, police have said, quoting from an initial statement that she gave from her hospital bed before her condition deteriorated rapidly.

A few minutes into the ride, her friend, 28, grew suspicious when the bus deviated from the supposed route and the men locked the door, according to her statement. They then taunted her for being out with a man late at night, prompting the friend to intervene and provoking an initial scuffle.

The attackers then beat him with a metal rod, knocking him unconscious, before turning on the woman who had tried to come to his defense. Police say the men admitted after their arrest to torturing and raping the student "to teach her a lesson".

At one point, the bus driver gave the wheel to another of the accused and dragged the woman by the neck to the back of the vehicle and forced himself upon her. The other five then took turns raping her and also driving the bus, keeping it circling through the busy streets of India's capital city, police said.

The woman was raped for nearly an hour before the men pushed a metal rod inside her, severely damaging her internal organs, and then dumped both her and her friend on the roadside, 8 km (5 miles) from where they had boarded it, police said.

Robbed of their clothes and belongings, they were found half naked, bleeding and unconscious later that night by a passerby, who alerted the police.

Last year, a rape was reported on average every 20 minutes in India. Just 26 percent of the cases resulted in convictions, according to the National Crime Records Bureau, which registered 24,206 rapes in 2011, up from 22,141 the previous year.

At first, authorities treated the assault on the medical student as one crime among many, and they were not prepared for the furious public reaction that led to running battles between protesters and police near the heart of government in New Delhi.

FAMILY ROLE MODEL

The woman, whose identity has been withheld by police, gave her statement to a sub-divisional magistrate on December 21 in the intensive care unit of Delhi's Safdarjung Hospital, according to media reports. She was undergoing multiple surgical procedures and her condition later began to rapidly worsen.

Ten days after the attack and still in a critical condition, she was flown to Singapore for specialist treatment. She died in Singapore's Mount Elizabeth Hospital two days later. Her body was flown back to Delhi and cremated there on Sunday in a private ceremony.

Family members who had accompanied her to Singapore declined to speak to reporters, but relatives told the Times of India newspaper she had been a role model to her two younger brothers.

Unlike most traditional Indian families who only send their sons to fee-paying colleges or universities, her parents pinned their hopes on the daughter and took loans to fund her studies.

She was born and brought up in a middle class Delhi neighborhood after her family moved to the city more than 20 years ago from the northern state of Uttar Pradesh.

Her male friend recorded his statement to a court days after the attack and helped police identify the six accused. He left for his hometown in Uttar Pradesh late on Saturday, missing the woman's funeral, media reported.

SHAME, ANGER IN SLUM

Four of the accused, all in custody, live in the narrow by-lanes of Ravi Das Camp, a slum about 17 km (11 miles) from the woman's home in southwest Delhi. Inside the slum - home to some 1,200 people who eke out a meager living as rickshaw pullers and tea hawkers - many demanded the death penalty for the accused.

"The incident has really shocked all of us. I don't know how I will get my children admitted to a school. The incident has earned a bad name to this place," said Pooja Kumari, a neighbor of one of the accused.

Girija Shankar, a student, said: "Our heads hang in shame because of the brutal act of these men. They must reap what they have sown."

The house of one of the accused was locked, with neighbors saying his family had left the city to escape the shame and anger. Meena, a 45-year-old neighbor, said she had wanted to join the protests that followed the rape, but was too scared.

"You never know when a mob may attack this slum and attack our houses. But we want to say we're as angry as the entire nation. We want them to be hanged," she said.

Two of the six alleged assailants come from outside Delhi, according to police. One is married with children and was arrested in his native village in Bihar state and the other, a juvenile, is a runaway from a broken home in Uttar Pradesh.

In India, murder is punishable by death by hanging, except in the case of offenders aged below 18.

President Barack Obama chastises lawmakers in fiscal cliff issue

WASHINGTON -- Senate leaders groped for a last-minute compromise Saturday to avoid middle-class tax increases and possibly prevent deep spending cuts at the dawn of the new year as President Barack Obama warned that failure could mean a "self-inflicted wound to the economy."

Obama chastised lawmakers in his weekly radio and Internet address for waiting until the last minute to try and avoid a "fiscal cliff," yet said there was still time for an agreement. "We cannot let Washington politics get in the way of America's progress," he said as the hurry-up negotiations unfolded.

For all the recent expressions of urgency, bargaining took place by phone, email and paper in a Capitol nearly empty except for tourists. Alone among top lawmakers, Senate Republican leader Mitch McConnell spent the day in his office.

In the Republicans' weekly address, Sen. Roy Blunt of Missouri cited a readiness to compromise. "Divided government is a good time to solve hard problems -- and in the next few days, leaders in Washington have an important responsibility to work together and do just that," he said.

Even so, there was no guarantee of success, and a dispute over the federal tax on large estates emerged as yet another key sticking point alongside personal income tax rates.

In a blunt challenge to Republicans, Obama said that barring a bipartisan agreement, he expected both houses to vote on his own proposal to block tax increases on all but the wealthy and simultaneously

preserve expiring unemployment benefits.

Political calculations mattered as much as deep-seated differences over the issues, as divided government struggled with its first big challenge since the November elections.

Speaker John Boehner remained at arms-length, juggling a desire to avoid the fiscal cliff with his goal of winning another term as speaker when a new Congress convenes next Thursday. Any compromise legislation is certain to include higher tax rates on the wealthy, and the House GOP rank and file rejected the idea when he presented it to them as part of a final attempt to strike a more sweeping agreement with Obama.

Lawmakers have until the new Congress convenes to pass any compromise, and even the calendar mattered. Democrats said they had been told House Republicans might reject a deal until after Jan. 1, to avoid a vote to raise taxes before they had technically gone up and then vote to cut taxes after they had risen.

Nor was any taxpayer likely to feel any adverse impact if legislation is signed and passed into law in the first two or three days of 2013 instead of the final hours of 2012.

Gone was the talk of a grand bargain of spending cuts and additional tax revenue in which the two parties would agree to slash deficits by trillions of dollars over a decade.

Now negotiators had a more cramped goal of preventing additional damage to the economy in the form of higher taxes across the board -- with some families facing increases measured in the thousands of dollars -- as well as cuts aimed at the Pentagon and hundreds of domestic programs.

Republicans said they were willing to bow to Obama's call for higher taxes on the wealthy as part of a deal to prevent them from rising on those less well-off.

Democrats said Obama was sticking to his campaign call for tax increases above $250,000 in annual income, even though he said in recent negotiations he said he could accept $400,000. There was no evidence of agreement even at the higher level.

There were indications from Republicans that estate taxes might hold more significance for them than the possibility of higher rates on income.

One senior Republican, Sen. Jon Kyl of Arizona, said late Friday he was "totally dead set" against Obama's estate tax proposal, and as if to reinforce the point, Blunt mentioned the issue before any other in his broadcast remarks. "Small businesses and farm families don't know how to deal with the unfair death tax--a tax that the president and congressional leaders have threatened to expand to include even more family farms and even more small businesses," he said.

Several officials said Republicans want to leave the tax at 35 percent after exempting the first $5 million in estate value. Officials said the White House wants a 45 percent tax after a $3.5 million exemption. Without any action by Congress, it would climb to a 55 percent tax after a $1 million exemption on Jan. 1.

Democrats stressed their unwillingness to make concessions on both income taxes and the estate tax, and said they hoped Republicans would choose which mattered more to them.

Officials said any compromise was likely to ease the impact of the alternative minimum tax, originally designed to make sure that millionaires did not escape taxation. If left unchanged, it could hit an estimated 28 million households for the first time in 2013, with an average increase of more than $3,000.

Taxes on dividends and capital gains are also involved in the talks, as well as a series of breaks for businesses and others due to expire at the first of the year.

Obama and congressional Democrats are insisting on an extension of long-term unemployment benefits that are expiring for about 2 million jobless individuals.

Leaders in both parties also hope to prevent a 27 percent fee cut from taking effect on Jan. 1 for doctors who treat Medicare patients.

There was also discussion of a short-term extension of expiring farm programs, in part to prevent a spike in milk prices at the first of the year. It wasn't clear if that was a parallel effort to the cliff talks or had become wrapped into them.

Across-the-board spending cuts that comprise part of the cliff were a different matter.

Republicans say Boehner will insist that they will begin to take effect unless negotiators agreed to offset them with specified savings elsewhere.

That would set the stage for the next round of brinkmanship -- a struggle over Republican calls for savings from Medicare, Medicaid and other federal benefit programs.

The Treasury's ability to borrow is expected to expire in late winter or early spring, and without an increase in the $16.4 trillion limit, the government would face its first-ever default. Republicans have said they will use administration requests for an extension as leverage to win cuts in spending.

Ironically, it was just such a maneuver more than a year ago that set the stage for the current crisis talks over the fiscal cliff.

Selling business to business (B2B) through online tools can be extremely difficult. The internet if full of slimy scams that make you look bad when you are simply contacted by someone online, asking about their current services or products related to your business. The prospect wonders if you are simply a robot that sent this email out to a bazillion of prospects hoping that a sliver percent respond. Cutting through the spam clutter is difficult but possible using a few methods.

Personalize the Email & Offer Value

In my business of selling website services I come across a lot of ugly websites. This encourages me to reach out to the owner of the business in order to?esquire?about what on earth they are thinking?! A simple email is a great way to reach them and supplies basic information for them to consider. As long as you send them a personal email you won?t be marked automatically as spam. However, when the prospect receives the email they possibly will classify you in their own minds as spam. One way to assure them you are not spam is to start the email with a personalized message. ?Hey Mike, I was in your restaurant eating last week?the meatloaf tasted awesome?and I noticed you needed [insert service]??

It?s also important to take some time give them something they find valuable. If you sell business insurance, put some basic tips that are related to their business and how you see they are lacking. I generally put together an analysis video of their website so they can watch and learn a few quick tips about why their website isn?t functioning as they might think. Much of the information I give them they could do on their own.

This might seem like ?a lot of preparation simply to contact one prospect. At times this is true but it sure beats getting caught in a spam filter and never have a chance to begin with.

Follow Up With a Phone Call

Follow up to make sure they realize you are human. I generally send a follow up email after my initial email and if they don?t respond I give them a call on the phone. I can?t count the times I have called someone and asked, ?Did you get a chance to review my email?? They then apologize because they thought I was spam. This gives them confidence to look through my email and consider the information.

Last Resort: Sent a Personalized Postcard

Many times I email a prospect and get no response. I send a follow up email?no response. I give them a call and get pushed to their voice mail again and again?no response. At this point I have put a lot of effort into contacting this person so I want to make sure I take every opportunity to let them know I am wanting to help them. The best last resort is to send a card in the mail. There are great services out there for this. The one I use is SendOutCards.com. You can do it all online and they make it simple. I generally send a postcard with a picture of their website on the front. This gets their attention when it comes with a stack of mail coupons and bills. Just yesterday I had a prospect (that I had already given up on) call me and say they got my postcard and apologized for not responding sooner.

Senate approves $60.4 billion Superstorm Sandy reconstruction bill

WASHINGTON (Reuters) - The Senate on Friday approved a $60.4 billion aid package to pay for reconstruction costs from Superstorm Sandy, after defeating Republican efforts to trim the bill's cost.

Senate Majority Leader Harry Reid urged the Republican-controlled House of Representatives to quickly take up the bill.

Both chambers have to agreed on a package by Jan 2, when the current term of Congress is expected to end, or restart the process of crafting legislation in 2013.

The bill's chances in the next few days could depend on whether President Barack Obama and congressional leaders reach a deal to avert the "fiscal cliff" of tax increases and spending cuts set to begin kicking in the new year.

Republicans complain the $60.4 billion reconstruction package requested by Obama is more than the annual budgets for the departments of Interior, Labor, Treasury and Transportation combined. They have urged a slower relief approach based on a congressional assessment of needs.

The Congressional Budget Office has estimated about $8.97 billion of the Senate bill would be spent in 2013, with another $12.66 billion spent in 2014 and $11.59 billion spent in 2015

It is that time of the year when reflections are made on the year that is about to pass, wishes are made for the new year, and a prediction or two start to pop from both amateur and professional?prognosticators alike. In years past we have done a?Patent Wishes article, which is currently in the works. We had a very busy year, from Supreme Court decisions to failed legislation to fight piracy on the Internet, to important Federal Circuit cases and implementation of the America Invents Act.

Indeed, for this inaugural edition of?Biggest Moments in IP we have a variety of reflections on a wide array of IP issues. Former Commissioner for Patents Bob Stoll?walked through some of the biggest items on the patent docket for the year. USPTO General Counsel Bernard Knight?reflected on the AIA and announcement that Director Kappos will step down in early 2013. Stephen Kunin?of Oblon Spivak gives us his Top 10 list in David Letterman style.?Former staffer to Senator Leahy (D-VT) and current lobbyist Marla Grossman?reflects on Senator Leahy?s decision to refuse the Chairmanship of the Senate Appropriations Committee to stay on as Chair of the Judiciary Committee. IP attorney and frequent feature contributor to IPWatchdog.com Beth Hutchens?focuses on several copyright and first amendment issues, and reminds us of the battle that ensued to defeat SOPA.

2012 was a seminal year in patents. ?The biggest moment was September 16, 2012 when the new procedures for Inter Partes Review, Post Grant Review for Covered Business Methods and Supplemental Examination came into force. ?Whether you like these new procedures or not, they change the way we contest patents in the Office and provide for a new way of curing defects in our own patents. ?The large number of Inter Partes Reexaminations filed just before that changeover indicates that our patent community is concerned about operating in the new environment. ?But I am confident that the leadership of the USPTO will do their best to implement the new procedures in an effective manner and will be willing to improve the processes as they learn of problems.

Patent law was also the subject of significant judicial shaping during 2012. ?Near the end of the year, the Supreme Court granted cert on AMP v. Myriad which calls into question the patentability of isolated genes. ?The Supreme Court decision in that case during 2013 is widely expected to further narrow the scope of patent eligible subject matter. ?Earlier in the spring of 2012 the Supreme Court had decided Mayo v Prometheus which reviewed the boundary between patent eligible methods and laws of nature. ?It is notable that the Court seemed to analyze the patent eligibility issues under 35 USC 101 using obvious standards more appropriate under 35 USC 103. ?The CAFC taking CLS Bank v. Alice en banc to assess patent eligibility of computer implemented inventions was an important moment, as was the decision in Akami Technologies v. Limelight where the Court provided for induced infringement without proving that all of the steps were performed by a single entity.

Another important event of 2012 was the President signing into law on December 18, 2012 the Hague Agreement on Industrial Designs and the Patent Law Treaty related to patent application formalities. ?I have a special interest in these provisions as I signed them for the United States, acknowledging our intent to ratify them, ?at the conclusion of the negotiations back in 1992. ?Some things take time!

Three things stand out to me as the biggest IP moments of 2012:

1. The AIA rulemaking: The USPTO published in the Federal Register nearly two dozen rulemaking packages to implement the AIA in 2012, and we are nearing completion on the final two. It is a monumental task to implement such a significant statute in such a short time frame, given the review required within the USPTO, as well as by other government agencies and the public.

2. Mayo v. Prometheus: The Supreme Court rejected our approach to evaluating whether patent claims directed to diagnostic methods are patent-eligible under Section 101. The Supreme Court indicated that the USPTO and the Federal Circuit had not been applying the judicial exceptions to Section 101 with sufficient rigor. The impact on diagnostic claims may be significant, and, as our brief in CLS Bank shows, we view the decision as having a more widespread impact, as well.

3. Director Kappos? departure: Dave Kappos has been an incredibly strong leader for the USPTO for the past three years. We are sad to see him go, but he leaves behind a much improved agency and Terry Rea will do a great job moving the agency forward.

Oblon Spivak?The end of any year provides the perfect opportunity to reflect on the significant events of the year.? Humorist Dave Berry has the Washington Post Magazine as the forum for his reflections, whereas we have Gene Quinn?s IP Watchdog blog to express our reflections on the significant events in the IP world.? In the grand style of David Letterman I list my assessment of the biggest moments in 2012 that have had a major impact on our patent law.

10. The Federal Circuit in In re Staats, 671 F.3d 1350 (Fed. Cir. 2012) held that applicants were entitled to continue filing continuing reissue applications with broadened claims after the original two-year period had expired.? Had the Federal Circuit affirmed the decision of the PTO?s Board it would have created a new prosecution laches style basis in patent law to refuse the grant of reissue patents.

9. The Federal Circuit in Aventis Pharma S.A. v. Hospira, 675 F.3d 1324 (Fed. Cir, 2012) concluded that inequitable conduct can be still be found under the heightened standards for materiality and specific intent enunciated in Therasense.? As a note to patent expert witnesses-the inequitable conduct defense is still alive albeit more difficult to prove.

8 The Federal Circuit in Marine Polymer Technologies, Inc. v. Hemcon, Inc., 672 F.3d 1350 (Fed. Cir. 2012) (en banc) concluded that no intervening rights are available unless a patent claim has been amended during reexamination.? Patent owners gave a sigh of relief when this decision issued.

7. Following a Supreme Court decision in Caraco Pharmaceutical Laboratories, Ltd. v. Novo Nordisk A/S, 132 S.Ct. 1670 (2012) holding that a generic may force correction of an inaccurate Orange Book use code, the Federal Circuit held that the district court must permit the patent owner to propose specific language to correct the use code.? 2012 WL 3064737 (Fed. Cir. July 30, 2012)

6. In Momenta Pharmaceuticals, Inc. v. Amphastar Pharmaceuticals, Inc., 686 F.3d 1348 (Fed.Cir. 2012) the Federal Circuit held that the Hatch-Waxman safe harbor applied to testing of batches of? a drug as required after FDA approval was reasonably related to the development of information to be reported to the FDA.? This decision further clarifies the scope of the experimental use exception.

5. The Federal Circuit in Akamai Techs., Inc. v. Limelight Networks, Inc,, 692 F.3d 1301 (Fed. Cir. 2012) (en banc), superseding 629 F.3d 1311 (Fed. Cir. 2010) changed the law of divided infringement.? The Court held that Limelight could be held liable for inducing infringement if it knew of the Akamai patent; performed all but one of the claimed method steps; induced others to perform the remaining step and others did perform the final step.

4. The Supreme Court decision in Mayo Collaborative Services v. Prometheus Laboratories, Inc., 132 S.Ct. 1289 (2012) levied a stunning blow to the field of personalized medicine.? The Court held that simply appending conventional steps even where physical matter if transformed was deemed insufficient absent novel and useful structure to make applications of laws of nature, natural phenomena and abstract ideas patentable.

3. The Federal Circuit?s decision to en banc rehear CLS Bank International v. Alice Corp. PTY Ltd., 2012 WL 4784336 (October 9, 2012) will dramatically impact subject matter eligibility determinations for computer implemented inventions directed to processes for practical applications of abstract ideas.? The implication on software implemented processes could be profound.

2. The Supreme Court?s renewed in interest in Association for Molecular Pathology v. Myriad Genetics, Inc., 2012 WL 4508118 (November 30, 2012) may reshape the contours of patent eligible subject matter in the life sciences when it addresses the question of whether human genes are patentable.

1. 2012 was the year for the major implementation of most provisions of the America Invents Act.? Kudos to Director Kappos, Janet Gongola and the members of the PTO staff who labored tirelessly in promulgating the September 16, 2012 effective final rules, implementing new systems and procedures and providing timely guidance on the AIA micro-site.? We appreciate the efforts of the PTO to listen to public input and implement the AIA in a fair and balanced manner.

?Holy Smokes, Batman!? Senator Leahy Chooses to Remain Chair of the Senate Judiciary Committee Rather than Chair the Senate Appropriations Committee.?

Perhaps no IP moment in 2012 was as momentous as when Batman aficionado and senior senator of Vermont, Patrick Leahy, announced on December 19 that he would forego the opportunity to Chair the Senate Appropriations Committee to remain Chair of the Senate Judiciary Committee, where he can continue his role as the steward of this nation?s patent and copyright laws.

The Chair of the Senate Judiciary Committee wields tremendous power over copyright, patent and trademark law, and most every intellectual property law passed by Congress over the past few decades bears his mark.? ?Senator Leahy has served as Chair of the Senate Judiciary Committee since January 2007 and from June 2001 through January 2003.? Under his watchful eye, the innovative and creative industries in the US have flourished.

Senator Leahy was a lead author of the Leahy-Smith America Invents Act, which was signed into law on September 16, 2011.? This consensus legislation to reform the nation?s patent system was the most comprehensive reform to the US patent system in nearly six decades.

The senator, who is a published photographer and has appeared in two Batman movies, has been a leading voice in the enforcement of US intellectual property rights.? He authored the Prioritizing Resources and Organization for Intellectual Property Act to enforce laws against stealing US intellectual property and was also a lead sponsor of the PROTECT IP Act, legislation to help protect American innovators and creators by cracking down on rogue websites dedicated to the sale of infringing or counterfeit goods.? He was a key author of the Digital Millennium Copyright Act, enacted by Congress to protect copyright works while allowing Internet access and online service providers to flourish and has had a hand in every major legislative IP initiative in recent memory ? from the Copyright Term Extension Act, the Trademark Law Treaty Implementation Act, the Digital Performance Right in Sound Recordings Act and the Performance Rights Act.

Is it any wonder that the state of Vermont is granted more patents per capita than any other state in the nation?? This small state has left a huge imprint on US patent and copyright laws, and its influence will most certainly continue now that Senator Leahy shocked and delighted the IP community by deciding to continue to Chair of the Senate Judiciary Committee.? ?Holy smokes, indeed!

I don?t think anyone would argue that patent law wasn?t huge in 2012.? The Apple/Samsung feud has certainly kept everyone mesmerized for the last several months- and rightfully so. ?But the non-patent side of intellectual property saw its fair share of the action.? In fact, there are issues rumbling around in my end of the sandbox that could have more of an impact on our daily lives than the technology in our smart phones. ?Here are three of the biggies from this year.

1. The Righthaven Takedown (or Was it a Smackdown)?? This could be the copyright case to end all copyright cases and it has been going on forever. ??Righthaven was a copyright holding company that in 2010 started filing lawsuits alleging online copyright infringement.? Lots of them.? While mass copyright infringement suits remain a contentious topic, Righthaven?s tactics went from questionable to downright bizarre.? The company all but tossed modern copyright jurisprudence out the window. ?This eventually led to the suits getting thrown out for issues that should have given pause to filing them in the first place? notably lack of standing and fair use.? But the damage had been done and, as of late, Righthaven is in some serious debt thanks to judgments against it, it has lost all of its assets (including the copyrights it was suing over), and is scrambling to find a way to avoid paying up.? The whole thing remains mired in the appeals process and it doesn?t look like the end is anywhere in sight for this hot mess of a case.

2. SOPA PIPA (the Wolves in Sheep?s Clothing).? SOPA (?Stop Online Piracy Act?) and PIPA (?Protect IP Act?) were the first major attempts by Congress to regulate the Internet.? The bills would have given the Justice Department the power to go after foreign websites accused of willfully committing or facilitating IP theft- even if there was only a suspicion of such activity.? The government would have been able to force U.S.-based Internet service providers, credit card companies, and online advertisers to cut off ties with those sites.? This was all under the guise of stopping piracy, so naturally the MPAA and the U.S. Chamber of Commerce were all over it, but the overreaching nature of the bills was terrifying to say the least.? Teh Interwebz fought back and several sites (including Wikipedia, Reddit, WordPress, and Mozilla) went dark for 24 hours in protest.? SOPA and PIPA are now dead but OPEN (?Online Protection and Enforcement of Digital Trade?) and the IAMA (?Internet American Moratorium Act?) have risen from the ashes.? Internet regulation promises to be a recurring nightmare so pay attention to what Congress is getting up to in the coming year.

3. Marco Randazza versus Crystal Cox (First Amendment Attorney Versus ?Investigative Blogger?).? We are starting to see more and more lawsuits being brought against bloggers for their online content, which is unfortunate, but this one is special.? In order to profit from her ?reputation management services? Ms. Cox bought a cadre of domains featuring Mr. Randazza?s name (such as marcorandazzasucks and other more pejorative terms that need not be repeated here).? The domains all pointed to lengthy screeds that were riddled with nasty, tasteless, and untrue things that give new meaning to the term ?Google bomb?. ?Not getting the reaction she hoped for Ms. Cox then targeted Randazza?s wife and did the same thing. ?Things got real when Cox went after Randazza?s little three-year-old daughter.? A UDRP (?Uniform Domain-Name Resolution Policy?) panel found that while there are big First Amendment protections for online content, cybersquatting and extortion don?t qualify. ?The case is now being heard in the District Court of Nevada where the judge just handed down a Temporary Restraining Order that prevents Cox from trafficking in, or registering, any more domains and requires her to fork over the existing ones.? This case has the potential to provide some very good precedent and it promises to be entertaining so get the popcorn ready and stay tuned.
